Terms of Service

1. Acceptance of Terms

By accessing or using LeadCloser AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users of the Service, including businesses and individuals who sign up for an account.

2. Description of Service

LeadCloser AI provides an AI-powered lead management and booking assistant for local service businesses. The Service includes an embeddable chat widget, lead dashboard, automated AI responses, and booking management tools. We reserve the right to modify or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access to your account. You must be at least 18 years old to use the Service. One account per business unless otherwise agreed.

4. Subscription and Billing

The Service is offered on a subscription basis at NZD $49 per month following a 30-day free trial. Your credit card will be charged automatically at the end of the trial period unless you cancel before the trial expires. Subscriptions renew automatically each month. You may cancel at any time through your account settings, and cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

5. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to collect personal information without proper consent, send spam or unsolicited communications, misrepresent your business or services, violate any applicable laws or regulations, or interfere with or disrupt the Service. You are responsible for all activity that occurs under your account.

6. Customer Data and Privacy

You retain ownership of all data you input into the Service, including lead information and business details. By using the Service, you grant LeadCloser AI a limited licence to process this data solely to provide the Service. We will not sell your data to third parties. Lead data collected through your embed form is owned by you. You are responsible for ensuring you have appropriate consent to collect and process the personal information of your customers in accordance with the Privacy Act 2020 (New Zealand).

7. AI-Generated Content

The Service uses artificial intelligence to generate automated responses to your leads. These responses are generated automatically and may not always be accurate or appropriate. You acknowledge that AI responses are not a substitute for professional advice. LeadCloser AI is not responsible for any outcomes resulting from AI-generated content, including missed bookings, incorrect information provided to leads, or any business losses. You should review your AI configuration regularly to ensure responses align with your business.

8. Intellectual Property

LeadCloser AI and its original content, features, and functionality are owned by LeadCloser AI and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service. Your business data and content remain your property.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, LeadCloser AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities arising from your use of the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.

10. Termination

We may suspend or terminate your account at any time if you breach these Terms, if we suspect fraudulent or abusive activity, or if required by law. You may terminate your account at any time by cancelling your subscription. Upon termination, your access to the Service will cease and your data may be deleted after 30 days.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of New Zealand.
